CONSTITUTION OF FENCING ASSOCIATION AT CENTRAL MICHIGAN UNIVERSITY

Preamble
The Fencing Association at Central Michigan University was created in order to bring the sport of competitive fencing to the Mt. Pleasant area.
ARTICLE I
Name
Fencing Association at Central Michigan University, hereafter referred to as FACMU
ARTICLE II
Membership
Section A. Membership
1. Student – Student membership entitles use of club equipment, facilities, and rights to attend club practices and events.
2. Non-Student – Non-student membership entitles use of club equipment, facilities, and right to attend club practices and events. FACMU is not responsible for fees associated with the use of the practice area (i.e. entering the Student Activities Center)
Section B. Membership Qualifications
Members in the FACMU shall not be denied because of age, color, disability, gender, familial status, height, marital status, national origin, political persuasion, race, religion, sexual orientation, veteran status, or weight.
Section C. Selection of Members
1. New members will be accepted at any time during the fall and spring semester at CMU.
2. Members will be notified the day of their acceptance.
Section D. Liability of members
All members must sign the liability waiver given to them by the secretary.
Section E. Voting Privileges
All student members are entitled to voting privileges.
Section F. Termination of Membership
1. Members may voluntarily terminate their membership at any time.
2. Membership may be terminated for failure to pay dues, failure to attend at least one club meetings per week unless with a valid excuse granted by a club officer, or failure to adhere to code of conduct.
3. A member may be terminated by a vote of two-thirds of the voting members. The member in question will be notified of their status.
ARTICLE III
Officers
Section A. Elected Officers
1. President – Responsible for running club meetings, casting a vote in the case of a tie, and running of public relations. The president also has the ability to write checks in the club’s name.
2. Vice President – Responsible for running meetings in the absence of the President, acting as parliamentarian, and the formation of any necessary committees.
3. Secretary – Responsible for keeping the minutes for each meeting and all documentation pertinent to the club.
4. Treasurer – Responsible for creating and maintaining the budget for the club as well as the handling of all funds including collection of dues. The treasurer has the ability to write checks in the club’s name.
Section B. Qualifications for holding office
1. All active members are on academic, social, or disciplinary probation are prohibited from holding any office – elected or appointed.
2. Only student members of the club may hold office
3. Officers must obtain a GPA of 2.5 or higher.
Section C. Selection of Officers
1. The election will be run by an election official who is a non-returning elected official. If all elected officials plan to return an elections official will be chosen from the general members.
2. Nominations will take place during the regular meeting of the third week of each spring semester.
3. Speeches will take place during the regular meeting of the fourth week of each spring semester.
4. Voting procedures will consist of a quorum which will be considered two thirds of the active members, a simple majority vote will be required for the election of each officer.
5. Votes will be cast in ballot method. Anytime during the fourth week of each spring semester a ballot may be cast to the election official.
6. Officers will officially assume their office the week following the election.
7. Officers will hold their position for a period of one year unless resignation or recall occurs.
Section D. Filling Vacancies
1. In the event that the position of president is vacant the vice president shall assume the role.
2. Vacant positions shall be filled by a vacancy election which is outlined in article V section F of this document.
Section E. Recall of Officers
1. An officer may be recalled for failure to perform duties or excessive absence.
2. A vote of two-thirds will be required for the impeachment of any officer.
3. All members of FACMU will be notified of the possibility of a coming recall vote of an officer.
Section F. Vacancy Elections
1. In the event of an elected official vacancy a vacancy election must be held within two weeks of the vacancy.
2. A vacancy election will be run by the president or in absence of that position the vice president.
3. Vacancy elections shall consist of nominations during one meeting, followed by speeches and voting at the following meeting.
4. A member must be nominated then seconded in order to be in election.
5. Voting will be done in ballot form during an actual meeting.
6. A quorum of two thirds the voting members must be obtained for an official election.
7. All members of FACMU will be notified in the event of a coming vacancy election.
8. The winner of a vacancy election will assume their role until the end of the term of the current elected officers.
ARTICLE IV
Advisors
An Advisor will be selected by a two-thirds majority vote from available faculty members at CMU.
ARTICLE V
Meetings
Section A. Meeting Times
Meetings will be held weekly throughout the fall and spring semester. The day and time will be decided by the elected officers.
Section B. Special Meetings
1. Special meetings may be called
for the planning and preparation of upcoming events, or if business needs to be
tended
to through the summer, or anything reason deemed pertinent by the elected
officers.
2. Special meetings will be called by the president.
3. Members will be notified with a minimum of two days notice of a special meeting.
Section C. Quorum
Quorum will be two-thirds of the voting body.
Section D. Parliamentary Authority
Roberts’s rules of order shall be used during meetings, the vice president shall assume the role of parliamentarian.
ARTICLE VI
Finances
Section A. Dues
1. Dues will be ten dollars per semester.
2. The dues will be paid by the third week of the semester.
Section B. Budget Planning
1. The budget will be prepared by the treasurer and presented at the second regular meeting of each semester.
2. A vote of two-thirds voting members will approve the budget.
Section C. Banking
1. FACMU has an account with Independent Bank which is located in the Bovee University Center.
2. The president, treasurer, and advisor have the right to write checks in FACMU’s name.
Section D. Allocation of Funds
An allocation of $50 or less may
be made by the elected officers with a two-thirds affirmative vote by the
elected officers.
For an allocation of a sum greater than $50, a formal motion
must be presented at business meetings.
Section E. Disposition of funds in event of inactivation
All proceeds will go to the United States Fencing Association.
ARTICLE VII
Committees
Section A. Types
1. Standing committees are those which continue from year to year in FACMU. A standing committee may be opened and closed by the elected officials when deemed necessary
2. Ad-hoac committees are those which may be formed, by the authority of the president when deemed necessary and shall exist for the remainder of the academic year or until finished with their assigned task, whichever occurs first.
Section B. Authority
1. The vice president oversees all committee activity.
2. Each committee will have a chair, recommended by the vice-president and appointed by the elected officials, which will oversee the regular running of the committee.
3. Committee chairs may be removed from their position at anytime when deemed necessary by the vice president.
4. Committee chairs may resign to the vice president at anytime.
ARTICLE VIII
Amendments
Section A. Procedure
1. Any elected official may make a technical change to the constitution at any time.
2. Any member, at any regular meeting, may propose a written amendment, final action on which will be delayed until the next regular meeting.
3. An affirmative vote of two-thirds of the membership shall be required for adoption of an amendment.
4. All members will be notified in the event of an amendment

ARTICLE IX
Rewriting of the constitution of FACMU
If at anytime the constitution of FACMU is determined to be outdated and/or in need of major repair an affirmative vote of two-thirds the voting members may form an ad-hoac committee to examine and rewrite the constitution. The new constitution must then be activated by an affirmative two-thirds vote by the voting members of FACMU.
BYLAWS OF THE CONSTITUTION OF FACMU
1. Code of conduct
All club members shall:
1. Represent the club with team spirit, sportsmanship and respect.
2. Follow the directions of the coaching staff at all times when pertinent to club activity or safety.
3. Use appropriate language and specifically avoid the use of profane or abusive language or obscene gestures.
4. Avoid all intentional or inappropriate touching, fighting, striking of another fencer with a weapon or in any other manner.
5. Respect the property of others, including host property and specifically avoid vandalism, intentional damage or theft of their property.
6. Avoid any disruption of a class, practice or private lesson.
7. Dress appropriate for training.
8. Make sure that their equipment is in safe working order.
9. Not engage in horseplay.
10. Practice control
11. Never carry weapons or equipment in a lazy or haphazard manner.
12. All fencers must wear masks when crossing blades. This must be in effect at all times
13. Fencers must be aware of their surroundings while dueling, such as non-fencers or equipment that may be in their path. Non-fencers must take car to avoid interference with dueling fencers.
14. The safety of guests of fencers is the responsibility of the host fencer. Children are the responsibility of their parents or guardians and care must be made to ensure that they do not interfere with fencers who are dueling or taking lessons.
15. The club, its members, or officers, no the venue shall not incur liability for injuries sustained during club times.
16. All fencers must also pledge to practice with care and safety. The faculty advisor or elected officers may counsel fencers who are careless or do not follow safety practices for their own benefit as well as for others’ benefit. The faculty advisor, or president in the absence of a faculty advisor, may also request a fencer leave the club if they continue to be a threat to themselves or to others.
